Training between Prosecution Office and Albanian State Police on enhancing the quality of criminal referrals
The need to improve the quality of criminal reports was lively discussed during a training workshop that took place on 22 January 2020, between the Prosecution Offices and ASP. A criminal referral not written properly, not containing the proper legal framework, not including some collected facts and evidences, in most of the cases will result in a decision of non-initiation of the case by the prosecutor and it will affect the workload of the prosecutors. Another issue that was discussed during the workshop concerned the application of article 59 of Criminal Procedure Code, which indicates if a person is aggrieved by certain criminal offences as foreseen in this provision, he is entitled to submit a request directly to the court and claim the reimbursement of damages. Currently, it happens that the aggrieved person makes a referral to the police instead to a request at the court. The workshop was attended by Judicial Police Officers and District Prosecutors who discussed on possible solutions. Representatives of School of Magistrate and Security Academy attended the workshop and explained the role of both Schools in improving the quality of criminal referrals through continuous trainings. Participants expressed the need to conduct more often joint trainings between Judicial Police and Prosecution Office.
